  • Payment information — processed by Stripe; we do not store card numbers

  • Browser type, IP address, and approximate location
  • Pages visited and referring URLs (server logs only; no behavioral tracking cookies)

3. How We Use Your Information

  • To respond to demo requests and schedule consultations
  • To set up and deliver contracted AI agent services
  • To send service-related emails and account notifications
  • To send SMS marketing messages — only if you have given express written consent
  • To process payments and send invoices via Stripe
  • To maintain records of leads and client interactions in Google Sheets
  • To improve our website and services
  • To comply with applicable law

4. Disclosure to Third Parties

We do not sell, rent, or trade your personal information. We share data only as necessary to operate our services:

  • Google LLC — lead and client data stored in Google Sheets/Drive using a service account governed by Google's Privacy Policy
  • Twilio Inc. — for SMS message delivery when you have opted in; Twilio may process your phone number in accordance with their Privacy Policy
  • Stripe Inc. — for payment processing; Stripe operates under its own Privacy Policy and PCI-DSS certification
  • Telegram Messenger — our internal notification system; individual user data is not forwarded to Telegram
  • Law and safety — we may disclose information if required by law, court order, or to protect the rights and safety of Mercavia, our clients, or others

5. SMS Communications and TCPA Compliance

Mercavia sends promotional and transactional text messages only to individuals who have provided express written consent as required by the Telephone Consumer Protection Act (TCPA) and FCC regulations.

6. Cookies and Tracking

Our website uses only essential session cookies required for basic website functionality (e.g., form state). We do not use advertising cookies, behavioral tracking, or third-party analytics scripts. If this changes, we will update this policy and add a consent banner where required by law.

We retain personal information for as long as necessary to provide services, comply with legal obligations, and resolve disputes. Lead inquiry data is retained for a maximum of 24 months if no service relationship develops. Client data is retained for 7 years following the end of a contract for accounting and legal compliance purposes. You may request deletion at any time (see Section 8).

  • Correction — request correction of inaccurate information
  • Deletion — request erasure of your personal data (subject to legal retention requirements)

  • California residents (CCPA) — you have the right to know what personal information is collected, to delete it, and to opt out of its sale (we do not sell personal information)

9. Children's Privacy

Our services are intended for businesses and business owners aged 18 and older. We do not knowingly collect personal information from individuals under 18. If we become aware that we have collected information from a minor, we will delete it promptly.

10. Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information. Data is stored in Google-managed infrastructure with access controls limited to authorized personnel. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify active clients by email. Continued use of our services after a policy update constitutes acceptance of the revised policy.
